1. Agreement to Terms
By downloading, accessing, or using Lola (the "App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you do not have permission to access or use the App.

2. Service Description and Disclaimer

2.1 Service Description
Lola is an AI-powered conversational companion that provides informational, entertainment, and personal development interactions.

2.2 Not a Professional Service
IMPORTANT: Lola is NOT a licensed therapy service, medical provider, or professional counseling tool.

Lola does not diagnose, treat, or cure any medical, psychological, or psychiatric conditions
Information and responses are not a substitute for professional advice or treatment
If you are experiencing a medical or mental health crisis, seek immediate help from qualified healthcare providers or emergency services (911)

3. User Eligibility and Account

3.1 Age Requirement
You must be at least 18 years old to use Lola. By using the App, you represent and warrant that you meet this requirement.

3.2 Account Responsibility
You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete information when creating an account

4. Limitation of Liability and Disclaimers

4.1 No Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOLA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any advice, information or content accessed through the Service
Any conduct of any third party on the Service
Unauthorized access, use, or alteration of your content or information
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO LOLA DURING THE PAST SIX MONTHS.

4.3 Personal Responsibility
You are solely responsible for any decisions, actions, or outcomes based on your interactions with Lola.

4.4 High-Risk Scenarios
Under no circumstances should Lola be used for decisions involving:

Medical diagnosis or treatment
Financial investments or major financial decisions
Legal advice or representation
Emergency situations requiring immediate professional intervention

5. Acceptable Use Policy
You agree not to:

Use the App for any illegal purpose or in violation of any laws
Post or transmit harmful, threatening, abusive, or defamatory content
Attempt to gain unauthorized access to the App's systems or networks
Use the App to distribute unsolicited commercial messages
Interfere with other users' enjoyment of the App
Attempt to reverse-engineer the App or its AI systems
We reserve the right to restrict access or terminate accounts that violate these terms.

6. Intellectual Property

6.1 App Content
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of Lola's owners and protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content
By submitting content to the App (including conversations with Lola), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content for the purposes of providing and improving the Service.

7. Subscription and Payment Terms

7.1 Subscription Model
Lola operates on a subscription-based model with a monthly fee of $99 per user.

7.2 Payment and Billing

Subscription fees are billed in advance on a monthly basis
All in-app purchases are processed through Apple's App Store payment system and are subject to Apple's terms and conditions

7.3 Auto-Renewal

Subscriptions renew automatically unless canceled before the next billing cycle
You may cancel your subscription at any time through your App Store account settings

7.4 No Refunds

All payments are non-refundable, including partial months of service
No refunds will be provided for partially used subscription periods

7.5 Price Changes
We reserve the right to change subscription prices with notice. Price changes will take effect at the next billing cycle.

8. Termination
We reserve the right to terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including, without limitation, breach of these Terms.

9. Indemnification
You agree to defend, indemnify, and hold harmless Lola, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees, arising out of or in any way connected with your access to or use of the App.

10. Governing Law
These Terms shall be governed by the laws of the State of Colorado, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Colorado.

11. Changes to Terms
We may modify these Terms at any time by posting the revised terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

12. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lola regarding the App and supersede all prior agreements and understandings.
